Q. I have a valid ticket but still received a payment notice. Why?
A. Perhaps the ticket was not on display. A ticket is not valid unless it is displayed right side up on the dashboard and visible outside the vehicle - that is clearly stated on every ticket. However, if you did have a valid ticket, then subject to any other relevant considerations, it is generally our policy to waive the Payment Notice if you send us the original ticket and a statutory declaration explaining why the ticket was not properly displayed. You are not compelled to make such a declaration but we may not be able to waive your Payment Notice without one.
Q. I received a payment notice while I was getting change. What can I do now?
A. Did you purchase a ticket?
Yes - You should complete an Application for Review and post it to us with your valid ticket and a statutory declaration that you were obtaining change and buying a ticket at the time the Payment Notice was issued. If you did have a valid ticket, then subject to any other relevant considerations, it is generally our policy to waive the Payment Notice if you send us the original ticket and a statutory declaration explaining why the ticket was not properly displayed. You are not compelled to make such a declaration but we may not be able to waive your Payment Notice without one.

Q. I didn’t see any signs stating that I need to buy a ticket, and now I have received a payment notice.
A. Signage at our car parks is very prominent and clearly worded. Just as you pay for goods at a shop, so too are you expected to pay for our services.
Q. I received a Final Reminder letter today but I do not recall receiving anything prior to this.
A. Upon issue, the notice is affixed to the vehicle. For your convenience the payment notice details are summarised in the reminder letter.
Q. Under what Act or law can you issue payment notices?
A. The payment notice is a demand for payment of liquidated damages for breach of your contract with us. At common law Care Park is entitled to damages for breach of contract.
Q. How did you obtain my name and address?
A. Details are obtained in accordance with the legal requirements of the State in which your vehicle is registered.
Q. Why has it taken so long for me to receive a reminder letter?
A. If payment is not received within 14 days, Care Park takes the required steps to obtain your details. That may involve applications to the court and the relevant registration authority. Unfortunately, those delays are beyond our control.
Q. I wasn’t driving the vehicle when the payment notice was issued. What should I do?
A. You may either pay the Payment Notice and ask the driver to reimburse you or alternatively, complete and return a Statutory Declaration (which you may obtain from most police stations) stating that you were not the driver of the vehicle at the relevant time and identifying the name and address of the person who was driving. You are not compelled to make such a declaration but if you fail to do so we have the right to seek a Court order compelling you to personally attend Court for the purpose of identifying the driver. Remember it is a criminal offence to provide a false declaration. Where Care Park has evidence that indicates the content of a statutory declaration is untrue, It is company policy to refer the matter to police for investigation and prosecution.
Q. What happens if I just ignore the payment notice?
A. Payment notices that remain unpaid are pursued by Crown Collections. Where legal proceedings are required, litigation is instituted by our solicitors, Parke Lawyers Pty Ltd.
